Under the Canadian Charter of Rights and Freedoms, everyone has the right to be free from arbitrary detention (section 9). A person may only be detained where there is clear legal authority, and if detained, they have the right to be informed promptly of the reason and to know their legal rights (section 10). Public agencies and their agents must act within the limits of the law, and enforcement practices used primarily to generate revenue—rather than to lawfully regulate conduct—raise serious Charter challenges.

What Is A Class Action

A class action is a legal proceeding where one or more people bring a lawsuit on behalf of a larger group who were affected in a similar way. Instead of everyone filing separate cases, the claims are handled together in one court process. In British Columbia, most class actions are “opt-out,” meaning you are automatically included if you fall within the defined class unless you choose to opt out. Opting out means you keep your right to bring your own individual lawsuit, but you will not be bound by the outcome—good or bad—of the class action.
