Pursuant to the South Coast British Columbia Transportation Authority Act, TransLink may designate certain areas within a transit facility as fare-paid zones. These are areas where passengers are generally required to possess valid proof of payment before entering or remaining within the designated space.
However, designating an unbounded area as a fare-paid zone by placing a sticker on a wall, mosaic, or other surface is vague and overbroad. Because such designations do not clearly define the boundaries of the restricted area, any location other than a moving transit vehicle cannot lawfully be treated as a fare-paid zone.
Any ticket issued for failing to possess valid proof of payment outside a lawfully designated fare-paid zone is unconstitutional and of no legal force.
